These general terms and conditions apply to all orders and agreements concluded or offers made through the website of LUX ReWear, hereinafter referred to as “the Webshop”. By placing an order on the Webshop, the customer agrees to these terms and conditions. LUX ReWear reserves the right to change these terms and conditions at any time. We advise the customer to review these terms and conditions regularly.
1.1 Customer: the natural or legal person who places an order through the Webshop or otherwise uses the services of LUX ReWear.
1.2 Agreement: any agreement between LUX ReWear and the customer regarding the sale and delivery of products through the Webshop.
1.3 Products: the designer items offered on the Webshop.
1.4 Webshop: the website of LUX ReWear, including the online store offering designer articles for sale.
2.1 These general terms and conditions apply to every offer, sale and delivery of products by LUX ReWear, unless otherwise agreed in writing.
2.2 By placing an order through the Webshop, the customer declares to agree to these terms and conditions.
3.1 All offers of products on the Webshop are without obligation and may be changed by LUX ReWear at any time.
3.2 The prices of the products are in euros and include the statutory VAT, unless otherwise indicated. Any shipping costs are in addition to the price of the product and are clearly communicated at checkout.
3.3 LUX ReWear reserves the right to correct errors in pricing and product descriptions, even after placing an order. In case of a pricing error, the customer will be informed and can decide whether or not to accept the order at the correct price.
4.1 To place an order, the customer must add the desired products to the shopping basket and follow the steps indicated in the ordering process.
4.2 The agreement is concluded once the customer has confirmed the order and LUX ReWear has accepted this order. This is confirmed via an order confirmation by e-mail.
4.3 LUX ReWear is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Bobbie Luxury Vintage will communicate this within five (5) working days after receipt of the order.
4.4 LUX ReWear is entitled to refuse orders or to impose conditions to the execution of the agreement, for example in case of incomplete or incorrect data.
5.1 Payment must be made via the payment methods available on the Webshop, such as iDEAL, credit card, Bancontact, or another payment method offered by LUX ReWear.
5.2 The prices stated for the products and services offered are in Euros, VAT is charged on second-hand items. Import duties shall be borne by the customer.
5.3 The customer is obliged to pay the total amount of the order (including any shipping costs) immediately after placing the order.
5.4 In case of non-payment, LUX ReWear reserves the right to cancel the execution of the order.
6.1 LUX ReWear ships worldwide with PostNL. Shipping costs for the Netherlands are € 15,95- and are fully insured. Shipping to other European countries costs € 20,- and is also fully insured. Shipping outside Europe costs € 30,- and is fully insured.
6.2 All items are shipped fully insured with POSTNL. After we receive payment, the item will be shipped within 1 to 3 business days.
6.3 The estimated delivery time for shipping within Europe is approximately 2-5 business days. For shipping outside Europe, the estimated delivery time is approximately 5-10 business days. LUX ReWear is not responsible for the duration of delivery, as this is beyond our control and depends on the delivery service.
6.4 Once your item has been shipped, you will receive a shipping number so that you can track your item at any time.
6.5 Import duties, taxes or other costs associated with importing the purchased item are not included in the price and are not the responsibility of LUX ReWear. These costs are the responsibility of the buyer. We advise the customer to check in advance the import duties and taxes of the destination country outside the European Union.
6.6 If the item you ordered is not available, we will contact you the same day. An order placed over the weekend will be shipped the following Monday.

By placing an order, the customer agrees to these terms and conditions.
8.1 LUX ReWear sells only original (vintage/ second-hand) designer items and guarantees the authenticity of the products.
8.2 All products are carefully inspected and described. Complaints about defects in the products must be submitted in writing to LUX ReWear within 14 days of receipt of the products.
8.3 In the event of a justified complaint, LUX ReWear will replace, repair or offer a refund for the defective product at its discretion.
9.1 LUX ReWear shall not be liable for damages resulting from improper use of the products.
9.2 LUX ReWear shall not be liable for any indirect, special or consequential damages arising from the use of the webshop or our services.
9.3 LUX ReWear’s liability is in any case limited to the amount of the relevant order, unless mandatory law provides otherwise.
10.1 Without prejudice to LUX ReWear’s other rights, in the event of force majeure, LUX ReWear shall be entitled, at its own discretion, to suspend the execution of your order or to dissolve the agreement without judicial intervention, by informing you in writing, and without LUX ReWear being liable for any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
10.2 Force majeure means any shortcoming that cannot be attributed to LUX ReWear because it is not due to its fault and is not for its account under the law, legal act or generally accepted rules. This may include (but is not limited to) circumstances such as natural disasters, war, strikes, government measures, transport problems, or other unforeseen circumstances beyond the control of LUX ReWear.
11.1 All delivered products remain the property of LUX ReWear until the customer has fulfilled all its payment obligations from the agreement in full, including payment of the purchase price and any additional costs, such as shipping costs.
11.2 As long as the customer has not paid in full, he is not entitled to resell, pledge or otherwise transfer the products. The customer has the right to use and/or keep possession of the products, but must treat them with due care and keep them in their original condition.
11.3 If the customer is in default of payment, LUX ReWear shall be entitled to reclaim the delivered products, regardless of where the products are located, and this without prior judicial intervention.
12.1 All intellectual property rights to the Webshop, including but not limited to logos, images, text and designs, are owned by LUX ReWear or its licensors.
12.2 The customer is not permitted to use the contents of the Webshop without prior written permission from LUX ReWear.
13.1 LUX ReWear guarantees that the products to be supplied meet the usual requirements and standards that can be set for them.
13.2 If the customer doubts the authenticity of an article purchased from LUX ReWear, the customer can contact LUX ReWear. LUX ReWear will then have the article authenticated by a third party. The cost of this authentication shall be borne by the customer.
14.1 LUX ReWear respects the privacy of its customers and handles personal data in accordance with applicable privacy legislation, such as the General Data Protection Regulation (AVG).

15.1 On all images or parts of images available on this website without the express permission of the author, copying of prints or entire portions of the text of downloaded documents is strictly prohibited by copyright.
16.1 If you provide LUX ReWear with an address in writing, LUX ReWear shall be entitled to ship all orders to that address unless you notify LUX ReWear in writing prior to shipment of a different address to which your orders are to be shipped.
16.2 If LUX ReWear allows deviations from these General Terms and Conditions for a short or longer period, tacitly or otherwise, this shall not affect its right to demand immediate and strict compliance with these Terms and Conditions. You can never assert any right on the ground that LUX ReWear applies these terms and conditions flexibly.
16.3 LUX ReWear is authorized to use third parties, such as delivery services, payment processors or other service providers, in the execution of your order(s), without this being to the detriment of the customer.
17.1 All rights, obligations, offers, orders and agreements to which these general terms and conditions apply, as well as these Terms and Conditions, are exclusively governed by Dutch law.
17.2 All disputes arising from or related to an agreement between the customer and LUX ReWear will be submitted exclusively to the competent court in the Netherlands.
